By accessing and using this website and services provided by BarPoppin Studios ("Company," "we," "us," or "our"), you accept and agree to be bound by and abide by the terms and conditions of this Agreement.

If you do not agree to abide by the above, please do not use this service.

2. Use License

Permission is granted to temporarily download one copy of the materials (information or software) on BarPoppin Studios' website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify or copy the materials
• Use the materials for any commercial purpose or for any public display
• Attempt to decompile or reverse engineer any software contained on the website
• Remove any copyright or other proprietary notations from the materials
• Transfer the materials to another person or "mirror" the materials on any other server
• Remove or obscure any watermarks, branding, or attribution

BarPoppin Studios has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by BarPoppin Studios of the site. Use of any such linked website is at the user's own risk.

BarPoppin Studios may revise these terms of service for its website at any time without notice. By using this website, you are agreeing to be bound by the then current version of these terms of service.

8. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the United States, and you irrevocably submit to the exclusive jurisdiction of the courts in that location.

9. User Content

Any information or materials you submit to BarPoppin Studios through this website, including but not limited to access requests and project information, is considered non-confidential and non-proprietary unless otherwise agreed in writing.

We have the right, but not the obligation, to use any submitted materials for any purpose without restriction or compensation to you.

10. Intellectual Property Rights

All content on this website, including but not limited to text, graphics, logos, images, and software, is the property of BarPoppin Studios or its content suppliers and is protected by international copyright laws.

11. Prohibited Conduct

You agree not to:

• Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the website
• Post or transmit abusive, defamatory, obscene, or otherwise objectionable material
• Attempt to gain unauthorized access to our systems
• Submit false or misleading information
• Violate any applicable laws or regulations

11A. 24-Hour Delivery Guarantee

24-Hour Delivery Guarantee

BarPoppin Studios guarantees delivery of eligible orders within 24 hours of production start on Story-Driven Songs, subject to the terms below.

Eligibility

To qualify for the 24-Hour Delivery Guarantee:

• The order must be fully completed and successfully submitted.
• Full payment must be received and authorized.
• All required information, reference materials, uploaded files, and customer instructions, must be provided at the time the order is submitted.
• The order must be placed before 2:00 PM Eastern Time (ET) on a business day.

Orders submitted after 2:00 PM ET will enter production on the next business day, and the 24-hour delivery period begins when production starts.

Production Clock

The 24-hour production clock begins only after:

• Payment has been successfully processed.
• All required order information has been received.
• Any required uploads are complete.
• No additional clarification from the customer is required.

If we are unable to begin production because required information is missing or clarification is needed, the guarantee begins once all necessary information has been received.

Customer Revisions

The 24-Hour Delivery Guarantee applies to the initial delivery only.

If the customer requests revisions, edits, changes, or additional work after delivery, revision turnaround times are separate from the initial guarantee.

Custom Requests

Highly customized requests, large commercial projects, bulk orders, or orders requiring extensive manual work may require additional production time. Any extended turnaround will be communicated before production begins.

Events Outside Our Control

Delivery times may be extended due to circumstances beyond our reasonable control, including but not limited to:

• Internet or hosting outages
• Cloud service outages
• Third-party AI service interruptions
• Payment processor delays
• Cybersecurity incidents
• Natural disasters
• Government actions or restrictions
• Power outages
• Labor disruptions
• Severe weather
• Other force majeure events

Customer Delays

The guarantee does not apply during any period in which production is delayed because the customer:

• Provides incomplete or inaccurate information.
• Uploads corrupted or unsupported files.
• Requests changes after production has begun.
• Fails to respond to requests for clarification.
• Changes the scope of the order.
• Communicates directly with the artist in the messaging system, as response times vary between artist and customer.

Production resumes once the required information is received.

Business Days

Unless otherwise stated, business days exclude holidays during which BarPoppin Studios is closed. If an order is received during a scheduled closure, production begins on the next business day.

Quality Commitment

If we determine that additional production time is necessary to deliver a product that meets our quality standards, we reserve the right to extend delivery rather than provide work that does not meet those standards. If this occurs, we will notify the customer as soon as reasonably possible.

Right to Refuse

BarPoppin Studios reserves the right to refuse or cancel any order that violates our Terms of Service, infringes on intellectual property rights, contains illegal content, promotes hate or violence, or otherwise cannot be fulfilled.

12. Artificial Intelligence in Our Creative Process

BarPoppin Studios uses AI as an assistance tool to help create and deliver your custom music and creative products. Our creative team leverages AI technology to:

• Enhance and accelerate the songwriting and composition process
• Generate initial concepts and arrangements based on your creative brief
• Assist with music production and sound design
• Expedite delivery of your finished product

All final creative output is reviewed, refined, and approved by our experienced human creators before delivery. While AI assists in the creation process, your final deliverable is crafted with human creativity, expertise, and quality assurance at every stage.

14. Portfolio & Promotional Use

By placing an order with BarPoppin Studios, you grant us the right to showcase the resulting audio and/or visual work for portfolio, promotional, and marketing purposes in an anonymized form, unless otherwise agreed in writing.

This may include use of the final song, instrumental, or studio-generated visuals, without personal names, likenesses, or private media. Personal photos, videos, or identifying details provided by the client will never be used publicly without explicit permission.

Clients may request a full portfolio opt-out prior to or during production. Approved opt-outs will not affect the quality, delivery, or pricing of the final work.
